1. Scope and Introduction

This Privacy Policy governs the collection, processing, and transfer of Personal Data by Hornet Biologicals and its subsidiaries, brands, and platforms, including FlokIQ. We pioneer sustainable livestock systems through biotechnology, omics, genetics, and precision feeding.

In providing our Services, we act as a Data Fiduciary (under India’s DPDPA) and a Data Controller (under GDPR) for user account data. For specific farm-level data processed on behalf of enterprise clients, we act as a Data Processor.

Crucial Distinction (Non-Personal Data): Data relating exclusively to livestock, genetics, animal microbiomes, environmental conditions, hardware telemetry, and farm operations that cannot reasonably identify a human being is not Personal Data. Hornet Bio reserves unrestricted, irrevocable, and global rights to use, monetize, and synthesize such non-personal data for research, AI/ML model training, and product development.


2. Information We Collect

We collect data through your direct interactions with the FlokIQ platform and automated IoT/biometric systems used in our livestock solutions.

2.1. Personal Data Provided by You

·        Identity & Contact Data: Name, business email address, phone number, farm/company name, and billing addresses.

·        Account Credentials: Usernames, passwords, and security PINs.

·        Financial Data: Payment gateway details, transaction history, and subscription status (processed via secure, PCI-DSS compliant third parties).

2.2. Automated & IoT Data Collection

·        Platform Telemetry: IP addresses, browser types, device identifiers, and platform usage analytics.

·        IoT & Sensor Data (FlokIQ): Data transmitted by hardware or sensors on your premises. While primarily non-personal (e.g., livestock vitals), if this data is commingled with identifying location data or specific user profiles, it is treated as Personal Data until aggregated.

3. Lawful Basis and Purpose of Processing

We do not process your data on a whim. Under global frameworks, including the DPDPA and GDPR, we process Personal Data strictly on the following lawful bases:

4. Pro-Company Rights: Aggregation, Anonymization, and AI Training

To drive biotech innovation, Hornet Bio aggressively employs data aggregation. By using FlokIQ and Hornet Bio services, you acknowledge and agree that:

1.      We may de-identify and anonymize Personal Data so that it no longer identifies any individual.

2.      Once anonymized, this data ceases to be regulated Personal Data.

3.      Hornet Bio retains exclusive, perpetual, and royalty-free rights to utilize this anonymized data to train machine learning models, publish omics/genetic research, develop sustainable livestock feeds, and commercialize new intellectual property.

5. How We Share Your Data

Hornet Bio does not sell Personal Data to data brokers. We share data strictly on a need-to-know basis to operate our high-growth startup:

·        Infrastructure & Cloud Providers: AWS, Google Cloud, or Azure for secure hosting of FlokIQ databases.

·        Biotech Research Partners: Academic or commercial partners (strictly limited to anonymized, non-personal genetic/livestock data).

·        Business Transfers: In the event of a merger, acquisition, VC funding round, or asset sale, your Personal Data will be transferred as a business asset under strict confidentiality agreements.

6. Global Regulatory Compliance

6.1. Indian Digital Personal Data Protection Act, 2023 (DPDPA)

If you reside in India, Hornet Bio processes your data subject to the DPDPA.

·        Notice & Consent: Your data is processed based on clear affirmative consent or for “certain legitimate uses”.

·        Duties of the Data Principal: Under Section 15 of the DPDPA, you are legally obligated to not register false or frivolous grievances, and to provide verifiably authentic information.

6.2. European Economic Area & UK (GDPR)

For users in the EU/UK, you possess the rights to Access, Rectification, Erasure (Right to be Forgotten), Restriction, Portability, and Objection.

·        Cross-Border Transfers: As a global entity, we may transfer EU data to India or the US. We rely on Standard Contractual Clauses (SCCs) and robust technical safeguards to ensure adequacy.

6.3. United States (CCPA/CPRA)

For residents of California and other applicable US states: We do not “sell” or “share” your Personal Information for cross-context behavioral advertising as defined by the CPRA. You have the right to request disclosure of the specific pieces of data we hold and request its deletion.

7. Data Security and Retention

We deploy enterprise-grade security tailored to protect highly sensitive biotech IP and your Personal Data. This includes end-to-end encryption (TLS 1.3), role-based access control (RBAC), and regular penetration testing. We retain Personal Data only for as long as necessary to fulfill our contractual obligations or meet legal/tax retention requirements (typically 7 years post-account termination). Non-personal, aggregated livestock data is retained perpetually.

8. Limitation of Liability

To the maximum extent permitted by applicable law (including the DPDPA and GDPR), Hornet Bio’s liability for any data breach, inadvertent disclosure, or privacy violation shall be strictly limited to the amounts paid by you to Hornet Bio in the twelve (12) months preceding the incident.
